How to send a takedown notice, what a valid notice has to contain, and how quickly one is handled.

How this is handled

BidBass responds to properly formed notices from rights holders and their authorised agents. A valid notice results in the listing being removed, normally within one working day of receipt and often faster. There is no argument, no appeal process to exhaust and no requirement to escalate anywhere before we act.

Notices are handled by a person, not a queue that discards anything not matching a template. If your notice is incomplete you will be told exactly what is missing rather than being ignored.

What a notice must contain

  • Identification of the copyrighted work you say has been infringed. Where several works are covered by one notice, a representative list is acceptable.
  • The exact address of each listing you are asking to have removed. A general statement that the site contains infringing material is not sufficient to identify anything.
  • Your contact details: full name, the organisation you represent, a postal address, a telephone number and an email address that reaches you.
  • A statement that you believe in good faith that the use complained of is not authorised by the rights holder, its agent or the law.
  • A statement, made under penalty of perjury, that the information in your notice is accurate and that you are authorised to act for the owner of the right you say has been infringed.
  • Your physical or electronic signature.

What we cannot act on

We cannot remove content on a general complaint that does not identify a specific listing. We cannot act on a notice sent by someone who does not state their authority to act for the rights holder. We cannot remove material hosted somewhere else, and we have no ability to affect any third party service.

Counter notice

If your listing was removed and you believe that was a mistake or a misidentification, you may send a counter notice containing your contact details, identification of the removed material and where it appeared, a statement under penalty of perjury that you believe the removal was the result of a mistake or misidentification, and your consent to the jurisdiction of the appropriate court. Send it through the form below with the subject set accordingly.
